Assessing the slow up-take of Condominium Certificates of title in Kampala District.
Abstract
The study analyzes the slow up-take of condominium certificates of title in Kampala district.
Relatively few titles have been issued under the Act, as the issues paper states that only about 100
titles had been issued under the Act as of 19 July 2007 and reasons for the slow take-up rate under
the Condominium Act are not known whether this is because the Act is not popular with
developers, or because it is not popular with the general public. Whatever the reason, the slow
“take – up” rate under the Act suggests the need for assessment for the past 20 years the Act has
been in existence. The objectives of this study are; finding out the barriers to acquisition of
condominium certificates of title in Kampala District and investigating the rate of application and
issuance of condominium certificates of title in Kampala District since 2001. The study objectives
required both cross-sectional data for qualitative analysis while time series data was gathered for
quantitative analysis. Cross sectional data was collected from condominium owners, Association
of real estate agents (AREA), Condominium property managers and Registrar of Land Titles in
MLHUD, office of the Chief Government Valuer in Kampala district. To address the first objective
on the barriers to acquisition of condominium certificates of title, structured questionnaires were
administered to condominium owners, real estate agents and condominium property managers
with aim of capturing reasons for the slow up-take of condominium certificates of title in Kampala
district. The second objective was mainly addressed to Registrar Land Registration in KCCA,
Commissioner Land Registration in MLHUD, senior land surveyor from Buganda Land Board,
National Housing estates condominium property managers and a senior Architect in NHCC, CEO
of AREA through interviews. Both primary and secondary data was analyzed using excel,
statistical package for social sciences (SPSS). Descriptive statistics and inferential analysis were
done on Quantitative data gathered and findings presented in the results section. From the main
objective of this research project the slow up-take of CCOTs in Kampala is slowly phasing out by
the introduction of the digital system which is making it easy to issue out CCOTs. This is evidenced
from the rising number of condominiums being developed around the divisions of Kampala that
is Nakawa and Rubaga. However, in divisions of Makindye, Central and Kawempe the concept
hasn’t been embraced much. The recommendations from the research; government should
embrace the concept of condominiums and also increase awareness amongst the developers and
the population through sensitization of the public about the process of getting CCOTs.
